Umno Semakin Nazak Susulan Pencalonan Perasuah Isa Samad di PRK Bagan Pinang

"Tengok UMNO dah tak ada tokoh lain untuk diketengahkan, terpaksa ambil orang lama dan bekas perasuah sebagai calonnya, bukankah ini bukti UMNO semakin nazak? Tak ada calon muda lagi ke UMNO nie?"

Nampaknya pencalonan mantan MB Negri Sembilan Isa Samad untuk PRK Batang Pinang dengan jelasnya menunjukkan Umno kini berada diambang kepupusan. Nampaknya seruan dan 'nasihat' mantan PM Mamak Mahathir yang lantang membantah pencalonan Perasuah Isa Samad tidak dihiraukan sama sekali oleh pucuk pimpinan BN/Umno.

Lebih serius lagi adalah tindak balas yang akan dilakukan oleh Ketua Pemuda Umno Khairy Jamaluddin dan penyokongnya kerana memang diketahui umum Khairy memang berhasrat bertanding di Bagan Pinang kerana inilah jalan ringkas menjadi MB di Negri Sembilan setelah diketepikan oleh PM Najib Razak dalam Kabinet Perseketuan. Sudah pasti, kempen Isa Samad akan disabotaj oleh Khairy dan kuncu-kuncunya.

Bacalah sendiri keluhan seorang penyokong Umno, Azli Shukri dalam Blognya mengenai pencalonan Isa Samad sebagai calon BN/Umno di Bagan Pinang:

Mungkin saya tidak layak bercakap soal siapakah calon yang paling layak untuk mempertahankan DUN Bagan Pinang. Hal ini sudah tentulah kerana saya bukan pengundi dan penduduk di sana. Namun demikian, izinkan saya memberi sedikit komentar berhubung isu ini, agar UMNO tidak melakukan kesilapan seperti mana yang berlaku di Permatang Pasir baru-baru ini. Mungkin ramai yang tidak tahu senario sebenar yang berlaku di dalam UMNO berkenaan bagaimanakah cara terbaik untuk memilih seseorang yang difikirkan layak bagi dicalonkan sebagai ADUN/Ahli Parlimen di sesuatu kawasan itu. Dalam kes DUN Bagan Pinang ini senarionya adalah seperti berikut :


Tan Sri Isa Samad merupakan Ketua UMNO Bahagian tersebut - dari segi senioriti seharusnya Ketua UMNO Bahagianlah yang mesti diangkat sebagai calon pilihan raya. Ini adalah bertujuan untuk mengelak daripada berlakunya perpecahan UMNO di bahagian tersebut, di samping menghindari daripada undi protes dan kelumpuhan jentera pilihan raya yang tidak bergerak ekoran ketidakpuashatian sesetengah pihak. Pucuk pimpinan tertinggi UMNO pasti berhadapan dengan dilema ini. Mungkin satu pihak tidak mahu Tan Sri Isa Samad dicalonkan, kerana beranggapan bahawa dengan meletakkan beliau sebagai calon UMNO, maka parti pembangkang lebih mudah membongkar segala salah laku politik wangnya selama ini. Sekali gus memburukkan lagi keadaan politik di sana. Tetapi, jika pucuk pimpinan tidak mencalonkan beliau, boleh jadi para penyokong Isa Samad pula yang akan memberontak serta melakukan undi protes dan tidak mahu bekerjasama bagi menggerakkan jentera parti untuk membantu calon yang telah dipilih itu.

Inilah dilema yang sering berlaku di dalam UMNO. Kita harus jujur dalam soal ini, dan merombak kembali sistem pemilihan calon pilihanraya yang sudah ketinggalan zaman. Selama ini, budaya dalam pemilihan calon-calon pilihanraya yang mewakili UMNO adalah berasaskan kepada senioriti dan kedudukan jawatan di dalam UMNO bahagian tersebut. Umpamanya, calon pilihanraya yang harus mewakili UMNO mestilah terdiri daripada Ketua Bahagian, atau pun Timbalan Ketua Bahagian, atau pun Naib Ketua Bahagian, atau pun Setiausaha Bahagian dan kemudian, barulah lain-lain jawatan. Perlukan kaedah ini dikekalkan lagi pada ketika ini? Bagaimanakah pula jika Ketua Bahagiannya, Timbalannya, Naibnya, Setiausahanya terlibat dengan rasuah? Masihkan UMNO mahu menjadikannya mereka sebagai calon pilihan raya juga?

UMNO perlu merangka satu mekanisma yang lebih telus dalam memilih ahlinya yang berupaya untuk diketengahkan sebagai calon pilihanraya. Pada hemat saya, mana-mana ahli UMNO pun boleh dipilih sebagai calon pilihanraya - yang penting riwayat hidupnya yang bersih dan pendidikannya pun "ok" (sekurang-kurangnya mempunyai ijazah pertama). Pada hari ini, pengundi semakin bijak, pengundi muda makin bertambah. Golongan ini lebih suka melihat title dan pendidikan sebagai asas untuk memilih seseorang sebagai wakil rakyat di kawasannya.

Jika ditanyakan kepada saya, saya berpendirian bahawa Tan Sri Isa Samad tidak harus dipilih sebagai calon UMNO untuk DUN Bagan Pinang. Hal ini bukanlah kerana saya ingin merendah-rendahkan jasa dan kredibiliti beliau selama ini, sebaliknya senario politik pada hari ini - khususnya untuk UMNO sudah semakin kritikal. Tersilap langkah dan percaturan, maka tunggulah balasannya. Kita tidak mahu pembangkang menjadikan segala sejarah silam Tan Sri Isa Samad sebagai modal politik mereka untuk berkempen. Pembangkang pasti mendakwa, "Tengok UMNO dah tak ada tokoh lain untuk diketengahkan, terpaksa ambil orang lama dan bekas perasuah sebagai calonnya, bukankah ini bukti UMNO semakin nazak? Tak ada calon muda lagi ke UMNO nie?". Sekarang, nah! apa yang hendak kita jawab, jika itu modal dan strategik pembangkang bagi menjatuhkan kredibiliti calon pilihan kita? Kita tiada jawapannya.

Kita harus akui - kerana kita sendiri yang telah menghukum Tan Sri Isa Samad dahulu, dan sekarang kita terimannya kembali untuk menjadi calon parti kita dalam pilihanraya. Bukankah itu sesuatu perkara yang pelik dan aneh? Sekali pun seluruh jawatankuasa UMNO Bagan Telok Kemang menyokong Tan Sri Isa, itu tidak bermakna rakyat akan menyokong UMNO. Pada hari ini, nada UMNO Bahagian sudah tidak sama lagi dengan nada rakyat jelata. Mungkin UMNO Bahagian suka kepada seseorang calon itu, tetapi rakyat tidak suka, dan boleh jadi rakyat suka, tetapi UMNO Bahagian pula yang tidak suka. Jadi mana keutamaan kita sebenarnya? Nak dapatkan calon yang disukai rakyat dan UMNO Bahagian, saya fikir buat masa ini agak sukar. Bukan UMNO tiada tokoh dan calon yang lebih baik di Bahagian masing-masing, tetapi, budaya kita yang suka mencatas bakat muda selama ini, menyebabkan UMNO dilihat seolah-olah tiada pelapis, ditambahkan pula apabila seseorang Ketua UMNO Bahagian itu terlalu lama memegang jawatan tersebut, sehingga ramai golongan muda bertambah muak dan mula berjinak-jinak dengan parti pembangkang.

Kesimpulannya, jika UMNO tidak mahu kehilangan moral, maka pilihlah calon lain dan bukan Tan Sri Isa - saya bercakap jujur, beliau bagus bekerja tetapi kondisi politik sekarang, saya fikir tidak mengizinkan untuk Tan Sri Isa "come back" dalam arus perdana politik Malaysia. Pada saya, sekali pun Tan Sri Isa mampu mempertahankan DUN Bagan Pinang, saya yakin majoriti UMNO akan merosot - dan ini sudah tentu akan menjadi modal pembangkang untuk mendakwa bahawa UMNO semakin hilang sokongan rakyat. Kita harus faham 10% pengundi Cina di DUN Bagan Pinang sebenarnya yang akan menentukan sama ada UMNO akan menang atau pun kalah. Wallahualam.Maafkan saya jika tulisan ini menyinggung hati mana-mana pihak.

Mahathir's Cancer

Few Malaysians disagree that Mahathir was both a destroyer and a creator.

During Mahathir's time the economy expanded and Malaysians now spend
their leisure time in enormous gleaming shopping complexes eating all
manner of foods.

Mahathir also gave Malaysia a terrible cancer that to this day has not
been cured.

Worse still, Mahathir did so deliberately.

Mahathir wanted power beyond what the law allowed.

Mahathir changed the law.

Mahathir is very intelligent.

He knew that he had to make changes stepwise, a little at a time, to
avoid strong objections that would block him from his goal of
attaining more power.

He removed the independence of the Judiciary, bringing it under the
control of the Executive.

He removed judges whose decisions did not favour himself or his cronies.

For the coup de gras he eliminated trial by jury.

Since then, judges, not juries, reached verdicts in trials.

As Malaysians are well aware, judges can be bribed or threatened into
rendering biased decisions that favour the Executive, government or
their cronies.

Judges also sometimes don't render a decision, they merely keep quiet!

Preposterous, but true, in BolehLand.

Juries are a valuable asset in a democracy.

They listen to and evaluate testimony and reach a verdict.

The lawyers present evidence (testimony & exhibits) to the jury and
create a tale about the evidence.

The judge sits as a referee, to ensure that everyone follows court
procedures and the relevant laws regarding evidence.

After the trial concludes the jury meets to discuss the case and
arrive at a verdict of guilt or innocence, or as sometimes happens,
they can't decide and there is a "hung" jury, meaning no decision was
reached.

The jury then announces it's verdict (or failure to reach a verdict)
in a hearing with all parties present.

If no verdict was reached the prosecution may decide to appeal.

There cannot be a second trial on the same charge of a person declared
innocent (no "double jeopardy"), thus no rearresting someone the
moment they step outside the court.

The above process ensures as much objectivity and fairness as possible
in making decisions, which is only fair, considering the serious
consequences court decisions have for the parties concerned.

Sentencing a convicted person, or deciding a penalty in a civil trial,
may involve a separate hearing, perhaps under a different jury, to
help ensure fairness and objectivity.

The sentencing hearing considers what sentence is appropriate to the offence.

The details of the offence are presented to the parties at the
hearing, with a judge as referee and lawyers for and against the
defendant arguing for different penalties.

The jury considers the facts of the case and the penalties permitted
by the relevant laws.

The jury then delivers it's verdict to the court hearing.

Juries have a very heavy responsibility, as their decisions have
enormous impact on people's lives and on society.

Juries are normally given leave from work and kept in isolation from
outside sources of information that may bias them.

If, as often happens, a juror needs clarification regarding a law or
fact of the case, they are permitted to ask the judge or refer to the
transcript of the testimony.

Jurors are normally expected to serve on a jury not more than once,
because of the heavy burden they bear.

Being available to serve on a jury is considered the responsibility of
every citizen of a democracy who is of sound mind and above the age of
majority.

Jurors are typically chosen from lists of registered voters.

There are exemptions possible from jury duty, being the sole caretaker
of young children, being ill, being related to a defendant, etc.

Jurors who are called to serve and who can't claim an exemption are
questioned by attorneys for the case.

The potential jurors are asked a series of questions to determine
their objectivity. For example, if the defendant is Chinese, the
potential juror may be asked how they feel about Chinese people.

If the potential juror replies that the Chinese are OK but 10 years
ago some devious Chinaman cheated them out of a lot of money in a
business deal, chances are the attorney for the defendant will raise
an objection, the judge will allow the objection and the potential
juror will be dismissed (although they may be recalled for a different
case).

Although it's a complex process and people may lie, trial by jury is a
very important safeguard for civil society & democracy.

Trial by jury, I think most people would agree, is preferable to trial
by a judge.

Which would YOU choose, if given the choice, should you unfortunately
find yourself the defendant in a court case?

I would choose trial by jury if I were tried.

Just in case my point is not yet 100% clear, Malaysia urgently needs a
return to trial by jury.

Nothing, including trial by jury, can 100% ensure a fair court process
but trial by jury gives the greatest possible chance that a court case
will be handled fairly.

Malaysia also urgently needs the Judiciary to independent of the Executive.

That independence is absolutely required for a democracy to be a
democracy in more than name only.

The Judiciary must be able to oversee the other branches of
government, including the Executive, to prevent those other branches
becoming too powerful and behaving in ways harmful to the rakyat.

Judges must be chosen from people who are knowledgeable, objective and
wise, particularly for positions in the High Court and Court of
Appeal.

The judges must have a high level of personal and professional integrity.

Malaysia is now at a very low point, but it's at the critical point
from which it can improve and reach it's potential of a prosperous
harmonious society or sink further and become a failed state, a hell
on earth for most of it's citizens, a paradise for an elite few who
are parasites upon the majority.

How the Judiciary is (or is not) reformed will play a crucial role, as
will various repressive acts, the ISA, Police Act, OSA, etc.

You, the rakyat, now decide what society you want to live in.

It's YOUR country, YOUR life, so YOU decide.

Do you want to live in a true democracy or a fake democracy?

I won't try to dictate which choice you make.

You are fortunate to have many sources of information, I'm confident
that you will use your intelligence to think about the information and
i'm confident that you will make wise decisions.

Can BN stave off Pakatan?

What are the chances of Barisan Nasional being replaced by Pakatan Rakyat at the next general election? Can a party which has dominated national politics for 52 years and counting be defeated?

First of all, a party which has governed without much democratic competition for so long would have bent all the levers of government under its control to serve its purpose of maintaining power.


Lack of fear of losing power breeds arrogance, corruption and disrespect for human rights. Abuse of public institutions and security services will be rampant. Power is often upheld by unjust laws and a compliant judiciary to rule favourably for the government.

In such long lasting regimes, elections are seldom free or fair as the ruling party controls the printed media and the airwaves to disseminate its propaganda while restricting the opposition from getting its message out.

Gerry meandering electoral boundaries, abusing postal votes and even holding elections on working days to disadvantage the opposition are tricks of the trade. To displace a dominant party in a one party system looks formidable or almost impossible but it isn’t actually so.

In fact it appears that dominant parties have a certain lifespan beyond which it gets harder and harder to hold on to power until it is given the boot by a dissatisfied electorate.

Even elections held on an unlevel playing field are ineffective in holding on to power.

Power that lasted an awesome half-century

History has shown that regimes which have ruled without competition for decades can lose it. The most recent example is the LDP of Japan which has ruled unbroken for 54 years except for a short 9 months stint but was kicked out of power in a crushing victory by the opposition.

The Kuomintang Party of Taiwan was ousted in 2000 after 51 years at the helm but has now regained it. The PRI of Mexico lost power after 51 years of rule and is still the opposition although it is gaining ground.

Does the PAP of Singapore look impossible to dislodge? If ever there is a country where the opposition has been beaten to a pulp this is it.

But Minister Mentor Lee Kuan Yew does not think so. He opined that PAP will be safe for the next two elections and after that, anything goes. Incidentally, another two elections would mean PAP would have ruled Singapore for about 50 years.

Now, what is this thing about half a century of rule? Is this the natural lifespan of a dominant party give or take a few years? BN has ruled for 52 years and going by the half century rule it has already overstayed and should be out by the next election shouldn’t it?

Actually there is nothing magical about 50 years but apparently, it is a good time for democratic renewal going by the number of regimes which have lost power after ruling that long.
It appears to be a sufficient duration for a ruling regime to build up its arrogance and abuses to a point where a groundswell of voter sentiment turn against it in disgust and sweep it from power.

It is a party for all members and let the delegates decide the future of the leaders and direction of the party,”On the central committee’s (CC) decision to suspend him for four years, Dr Chua said: “Are they trying to say the CC is more supreme than the extraordinary general meeting (EGM)?”MCA will hold an EGM on Oct 10 to solve a crisis plaguing the party.“I will leave it to the wisdom of the MCA delegates to decide my fate and I believe they will make a wise decision in the interest of the party,” he said.

Whatever the case it appears that MCA looks set to be dead and buried with the majority of Malaysia Chinese are not bothered with the on going fued in MCA as they throw their support solidly behind Pakatan Rakyat. The Chinese after all see themselves being used by MCA to fish votes for MCA's Taiko, Umno. So it doesn't matter to them whatever Justice4OTK or Omar Goh Wei Liang or for that matter whatever the BN controlled MSM spins at the end of the day.

This is well summed up by Sin Chew“Uncles” and “Aunties” in the office, coffee shops and other public places are still talking about it but I'm sorry to say that most of them do not actually care about whether MCA is going to collapse. Instead, they are just watching the fun."

Behind the attack on Malaysia Today

A reader, Morning Dew posting from Australia, believes that Malaysia Today suffered an attack on its server in the US — and stretching the bounds of possibility, says “it is not inconceivable that Kuala Dimensi” could be behind it.

He (she?) points the finger to the Internet providers, the government, and possibly even kuala dimensi. Of course it could also be possible that Indonesian hackers did so (but then they would plant an anti-Malaysia message). But it’s likely to be a combination of the Port Klang Free Zone debacle, the Saiful Bukhari alleged sodomy case, and the Bagan Pinang by-election. The Barisan Nasional names its candidate on Tuesday. Nomination day is Friday. The election is in two weeks’ time. And then there’s always Dr Who, ever-present everywhere.

Justice for Kugan petition to DYMM YDP Agong 26/09/09 - what I observed

This is what I observed at the peaceful assembly in front of the Istana Negara on 26 September 2009, which was called by Hindraf and the Human Rights Party Malaysia to deliver a petition to the the DYMM Yang Di-Pertuan Agong. The petition, which you can download and read here, pleads to the YDP Agong for justice for Kugan and his family. Eight months after his death in police custody, the killer/s of A. Kugan, have yet to be arrested and brought to justice.

I tried to get to the Istana Negara at about 10.30 a.m., but there was a police roadblock where Jalan Dewan Bahasa joins Jalan Istana, and the police were not allowing any cars to get past. I made some calls and found out that the petitioners were meeting at Naga's Restaurant in Brickfields, which is where I headed to.

Members of Kugan's family were already there, including Madam Indra (his mother), sister, brothers and uncle. With them were a small group of Hindraf and MHRP folks; MP for Kapar YB S Manikavasagam, MP for Puchong YB Gobind Singh Deo, and ADUN for Kota Shah Alam YB M. Manoharan were also there. Soon, Human Rights Party Malaysia pro-tem secretary-general P. Uthayakumar and Hindraf coordinator Mr. Jayathas arrived, and the group organised themselves for the trip to the istana.

Singapore's obsession holds lessons for us all

I hope those who look after the education system in this country will learn a thing or two from here.

When school officials from across the world come here to learn why Singapore's students score so well on international science and math tests, it doesn't take them long to discover the secret -- a national obsession with education.

It even shows up on its dollar bills. While U.S. and Latin American currencies portray images of national independence heroes, Singapore's 2-dollar bill -- the most widely circulated since there is no smaller denomination -- shows students in a classroom listening to a professor, with a university in the background. Underneath, there is just one word, ``Education.''

During a weeklong visit, I found symptoms of this national obsession everywhere: public libraries at malls, big media headlines about students who excel academically and an education minister who -- perhaps symptomatically -- also serves as second minister of defense.

There are some things that Latin America, a region that has some of the world's lowest education standards, could learn here.

Only four decades ago, when Singapore was told by Great Britain that it could no longer remain a British colony, Singapore was so poor -- and hopeless -- that no other country was interested in taking it over. Its per capita income at the time was the same as Jamaica's.

Today, largely thanks to its focus on education, Singapore is the world's ninth-richest country in per capita income. Comparatively, the United States is 10th, Mexico 82nd and Jamaica 123rd.

``For us, education is a matter of survival,'' National University of Singapore President Tan Chorh Chuan told me. ``Singapore has no natural resources, so we can't survive if we don't focus on our people's minds.''

Indeed, this country imports virtually everything, including -- until recently -- all the water it consumes.

When it comes to education, Singapore's rags-to-riches story is just as startling. Four decades ago, a sizable part of its population was illiterate. Today, Singapore ranks No. 1 in several categories of the Trends in International Mathematics and Science Study test of fourth- and eighth-graders' abilities in math and science.

While Singapore students were first in science in the TIMSS test, U.S. students ranked eighth. Most Latin American countries rank so low in broader international academic tests that they don't dare participate in the TIMSS.

At the higher education level, the National University of Singapore is ranked No. 30 in the London-based Times Higher Education Supplement's index of the world's 200 best universities. Comparatively, Harvard ranks No. 1 on the list, and the highest-ranking Latin American university on that list is the National Autonomous University of Mexico, in 150th place.

How did Singapore do it? The conventional wisdom here is that its founder, authoritarian leader Lee Kwan Yew, had the vision of turning Singapore into an English-speaking country with bilingual education, in which all students are taught in English and learn their mother tongue -- be it Mandarin, Malay or Tamil -- as a second language. That helped Singapore become a major world trade hub.

He also turned the education system into one of the world's toughest meritocracies, which produces highly skilled workers that attract major multinational companies, and increasingly exports high-tech goods.

Singapore's academic meritocracy starts in first grade, where children are ranked by their academic performance, from first to last.

At the Rulang Primary School, a 2,100-student public elementary school specializing in robotics teaching, teachers looked at me somewhat puzzled when I asked whether letting a 7-year-old child know that she is the worse of her class isn't putting too much pressure on her too early in life.

``No,'' school principal Cheryl Lim shrugged. ``We rank them in a way to tell them that this is their ranking at this point in time, and that they can do better next year. It's not to tell them that they are the worst in their class.''

Depending on how they score on a national test at the end of elementary school, students are sent to different secondary schools, each of which has a special focus -- be it robotics or basketball. Through a process officials call ``streaming,'' schools identify students' abilities and put them on various academic tracks that eventually lead them either to the university or to technical and vocational schools.

At the end of junior high school, students have to take another test. Those with the highest scores can apply to two-year junior colleges that serve as stepping stones to one of the country's three universities. Middle-of-the-road performers generally apply to three-year polytechnic institutes, and low-achieving students end up in two-year institutes of technical education, where they learn hair styling, assistant nursing and dozens of other skills.

U.S. expatriates here like to say that while America is a guilt-driven society, Singapore is a shame-driven society: Parents here dread others seeing their children doing poorly in school.

Discipline is strict. When a visitor shows up, children bow. Students wear uniforms all the way through community college-like technical schools. Mohawk haircuts, dyed hair, jewelry or baggies are a no-no, even in junior college.

But education authorities and academics deny that this is a draconian system. They point out that polytechnic institutes and institutes of technical education provide career opportunities -- and self-esteem -- for everybody.

``That is the jewel of my crown,'' Education Minister Ng Eng Hen told me in an interview. ``Almost all countries have good universities, but few have a system of good vocational schools.''

Indeed, the ITE College East, one of the largest vocational schools, has ultra-modern buildings and state-of-the-art sports facilities that are often more sophisticated than those of more prestigious universities. ITE officials say that sends a message to students that they are important, which helps motivate them.

During my visit to ITE, I was briefed alongside a visiting journalist from China, who told me that his country wants to learn from Singapore's success in offering educational alternatives to low-achieving students.

``By the time you are 10, you are put on a stream,'' says Kishore Mahbubani, dean of the National University of Singapore's Lee Kuan Yew School of Public Policy, and one of the country's best-known intellectuals. ``No brain is wasted in Singapore.''

Ninety percent of 18-year-old students finish either junior college, polytechnic institutes that focus on engineering or nursing, or vocational schools that train hair-styling professionals, cosmetologists and assistant nurses. Among those who go on to universities -- NUS has 35,000 applications a year, for 6,000 openings -- 50 percent pursue part of their studies in the United States, Europe or other foreign countries.

``Internationalization is key for us,'' says Tan, the NUS president. ``We have 66 joint- or double-degree programs with foreign universities. We are changing the concept of the university from a place to a bridge, or a portal, to a much larger network.''

My opinion: Because of its small size and its authoritarian regime -- government critics joke that you can't fish in Singapore because even the fish keep their mouths shut -- it's hard to pick this country as a universal model.

Still, Latin America -- and the United States -- could learn something from Singapore's obsession with education, and from its academic safety net for low achievers.

Perhaps we should start by putting the word ``education'' on our dollar bills, just to remind ourselves of what makes countries rich in the increasingly knowledge-based global economy.

Cybercriminal

Malaysia loves to be the tallest or biggest in something.

Now Malaysia continues that practice by being one of the biggest cybercriminals.

Malaysia is launching denial of service (Dos/DDos) attacks on Malaysia Today.

Those attacks overload the Malaysia Today site server denying access
by legitimate visitors.

Denial of service attacks are a cybercrime.

Such attacks in effect put a wall between a site and it's users.

Why are such attacks a cybercrime?

For example, a company could attack the site of a competitor.

That would be in effect a business welding a shutter covering the door
of a rival business.

That would not be tolerated, for obvious reasons.

The Malaysian government is committing a cybercrime by blocking Malaysia Today.

The Malaysian government is also once again demonstrating it's utter
contempt for civil society and the law by engaging in cybercrime.

Whatever damage Malaysia Today inflicts on the Malaysian government
the Malaysian government is inflicting additional damage on itself by
engaging in cybercrime.

Malaysia Today is merely exposing wrongdoings of the Malaysian government.

The Malaysian government can stop Malaysia Today without resorting to
cybercrime, very simply actually, just become a responsible
government, end corruption, deaths in custody, cheating in elections,
exploiting the poor and the myriad other misdeeds of the government.

Independent media such as Malaysia Today have a vital role in
democratic societies, the role of keeping the government honest and
exposing official wrongdoing.

Malaysians are truly fortunate to have Malaysia Today and other sites
that enable receiving information from sources other than
state-controlled sources.

Makkal Sakthi Party - Hindraf cries foul!

Hindraf (Hindu Rights Action Front) chief P Waythamoorthy is livid over news reports that attempts are being made to connect the strictly apolitical human rights and equal rights movement with the newly-registered Malaysian Makkal Sakthi Party (MMSP).

Prime Minister Najib Abdul Razak will be officially launching MMSP, which is headed by a former Hindraf activist, on Oct 10.

“There seems to be a convoluted agenda to draw similarities between Hindraf and MMSP and this is being encouraged by the powers-that-be,” said Waythamoorthy in a statement to Malaysiakini.

“It is strange that the prime minister agreed to launch a party which is not a member of the ruling Barisan Nasional. The speed with which MMSP was registered speaks for itself.”

Waythamoorthy (left) pointed out that MIC, a founder member of the BN, has also warned several times that it would veto any application by the MMSP to join the BN. Admission to BN must be unanimous, while expulsion is by a simple majority.

“The pair behind the MMSP were ordinary members, if the term can be used, of Hindraf,” said Waythamoorthy.

MMSP is headed by RS Thanenthiran (right), who is party president, and Kannan Ramasamy, the party secretary-general.

Both men were active with Hindraf after the government crackdown where a number of the movements lawyers and a volunteer were arrested, noted Waythamoorthy.

Hindraf legal advisor P Uthayakumar, Waythamoorthy's elder brother, activist T Vasanthakumar and three other lawyer sympathisers of Hindraf were incarcerated at that time under the draconian Internal Security Act after a Singapore paper linked the movement with the Liberation Tigers of Tamil Ealam (LTTE).

'Makkal sakthi' expropriated

Explaining the differences between Hindraf and MMSP, Waythamoorthy stressed that the latter is trying to capitalise on the term “makkal sakthi”, Tamil for people power, which was made popular by the rights movement in late 2007.

That was when Hindraf supporters took to the streets of Kuala Lumpur in the thousands to press “for the legitimate aspirations of Malaysians of Indian-origin”.

Makkal sakthi also helped unleash the political tsunami on which the opposition Pakatan Rakyat coalition rode to power in five states and Kuala Lumpur in the general elections last March, added Waythamoorthy.

“Hindraf will continue to be an umbrella NGO for 30 Indian-based groups which agreed and contributed towards its formation,” said Waythamoorthy. “We are neither pro-Pakatan or anti-BN despite our support for the opposition in the last general election.”

The thrust of Hindraf, according to Waythamoorthy, is to support whoever is pledged towards dismantling the apartheid-like structure of race and religion which has descended on Malaysia.

At the same time, he pledged, the movement will oppose anyone who wants to divide the people of Malaysia along racial and religious lines in politics.

“In short, we are for the truth, regardless of how some people may feel about it,” said Waythamoorthy. “The truth cannot be politicised or sacrificed for reasons of political expediency.”

Drawing a distinction between BN and Umno, the Hindraf chief vowed that his movement will have nothing to do with the Malay-based party, which he blames for all the woes of Malaysians of Indian origin and other Malaysians too.

He does not see Umno redeeming itself ever in the eyes of the Indian community “because it is too set in its ways and politics, and will continue on its death-wish path and implode sooner rather than later”.

Elder brother has right to form own party

The MMSP, claimed Waythamoorthy, is like many other Indian-based political parties who want to emulate the MIC and bring in the Indian votes for the BN to shore up Umno in power “in return for some crumbs from the spoils of office”.

“MMSP is not even a splinter group of Hindraf,” stressed Waythamoorthy. “Neither is the Human Rights Party which is headed by my brother P Uthayakumar and still awaiting registration, unlike the MMSP.

“Uthaya has never been a Hindraf activist. He was only the legal advisor.”

Uthayakumar thinks that the objectives of Hindraf need to be given a political platform, according to Waythamoorthy.

While he has no quarrel with his brother, he begs to differ since “Hindraf is not his call”.

However, Waythamoorthy concedes that his brother has a right to form his own political party to at least drive home to the electorate the lessons that he has learned during his years in detention under the ISA.

He declined to dwell further on the Human Rights Party,which he was given to understand has no links either with the MMSP.

Waythamoorthy has been left stranded in in London, where Hindraf has its headquarters now,after the Malaysian government revoked his international passport. In addition, the movement has offices in Belgium, Geneva, Australia and New York.

The movement's main work is to liaise with the United Nations, the US State Department and the UK Parliament. Hindraf is also awaiting recognition from the European Parliament.
It also releases the Malaysian Indian Minority and Human Rights Violations Annual Report at the Global Organisation of People of Indian Origin and Pravasi Bharathiya Divas international conference every year.

The latter is a gathering of the Indian diaspora where Hindraf and MIC, among others from Malaysia, are represented.

ISLAM & YOGA : COMPATIBILITY ON THE HIGHEST LEVEL ???

It can be valid and beneficial for Muslims to learn yoga, not as their spiritual path per se, but as a valuable adjunct to the spiritual path of Islam. Islam is a complete, integral spiritual path, so yoga is no substitute for any Islamic requirement. The Prophet said that wisdom is the believer's stray camel: wherever he finds it he will recognize it (and claim his right to it).

How to explain the many points of correspondence between yoga and Islam? Did these ancient teachings travel from India to Arabia? No—there is no need to assume such a horizontal transfer; the sacred truths are revealed vertically from Heaven to all peoples.

There are close similarities between Islam and yoga not because of borrowing or cultural diffusion, but because of both originating in the Primordial Tradition, sanâtana dharma, al-dîn al-hanîf, which all the prophets of Allah have brought and reaffirmed throughout the ages, among all nations, revealed directly from the Creator.

Are The Malay Rulers an Extension of BN/Umno?

The Scribe had written here calling on His Majesty DYMM Sultan Mizan Zainal Abidin to dismiss the current BN government so that the Rakyat (People) can have the opportunity to vote for a Government that is free from corruption, credible, just and more importantly restore Malaysia's image in the eyes of the World.

The Scribe however has been dumbfounded reading this in Malaysiakini:

Pahang sultan urges rakyat to continue backing BN

The Sultan of Pahang, Sultan Ahmad Shah, has called on the people to continue supporting the government so that more social, economic and educational developments would be implemented for them.

Are the Malay Rulers an extension of BN/Umno? If this is the position of the Malay Rulers, then we may as well recite the Al Fateha for Democracy in Malaysia.

Insinuations of Ronnie Liu's Criminal Activity?

It appears that Omar Goh Wei Liang has gone overboard in his attacks on Pakatan Rakyat leadership. The following is what he wrote in his blog A PIECE OF MY MIND (APOMM) regarding YB Ronnie Liu (pic above).

You see, when we start a presentation of arguments, we present facts. However, each time I presented some facts, you tend to manipulate the facts to supplement your argument.

You say "Don't show me example of opposition sacrificing themselves for the cause of the party. I already know that they are more honourable than UMNO!"

But what makes the Opposition more honorable than UMNO except in your perception ?

Is Ronnie Liu more honorable than any politician ? Mind you, SELCAT is questioning his expenses !

In your statement "You may have shown some cases where opposition may have won their court cases but the cases that have gone against them are so much more!"

I wonder what it means. Does it mean that if the Opposition wins more cases, the Courts are fair ?

Dr Mahathir has put in place many systems and policies for our country which I believe you have not read. The delivery of the system has been manipulated and exploited by many Malaysians to make quick bucks at the expense of the country.

That does not make the idea contributor (Tun) the bad one but places Malaysians ethics at the frontline for our thoughts.

I think YB Ronnie Liu ought to sue this spoilt fat rich brat Omar Goh who acts as though he is a bastard son of Mamak Mahathir for such evil insinuations.

They just did what the Cabinet knew all along they were doing and with the full permission of the Cabinet."

As usual, the reaction of the 'powers that be' i.e. the Judiciary, the Police and the MACC is to go after the Messenger rather than the culprit, the BN/Umno Regime which rules Malaysia.

The Scribe and the Rakyat call on His Majesty DYMM Sultan Mizan Zainal Abidin to dismiss the current BN government so that the Rakyat (People) can have the opportunity to vote for a Government that is free from corruption, credible, just and more importantly restore Malaysia's image in the eyes of the World. RUN!!!!

I refer to "Popping floors make condo owners hopping mad" in Malaysiakini.

Thank God (and Ananda Krishnan and Mahathir) for Astro.

Astro had a true story of a shopping complex that collapsed killing many people.

The cause was overloading from improper renovation.

The complex owner had been advised against the changes to the building
but ignored the advise.

One day a small part of a floor suddenly rose upwards.

Actually, that area was above a column.

What had happened was the remainder of the floor had sunk, because the
floor too weak, the column pushed through the floor.

Then it seemed nothing more happening.

WRONG!

The column below the raised area was no more support the floor.

Other areas of floor above columns now had more load.

Later same thing happened again, an area of floor raised up.

Then another...

There was movement and shaking, people got scared.

TOO LATE!!

There was not enough support for the floor.

The floor fell on to the floor below.

The floor below fell...

The complex collapsed similar to the World Trade Centre in New York.

Whatever the details cause of the popping floors of the Heron, the
symptoms are VERY much like those of the shopping complex, including,
as Priya said, noticeable movement and shaking.

I have ONE word to say to residents of the Heron: RUN!!!!

Hindraf on Mahathir's 'sin' against Indians

Hindraf chairperson P Waythamoorthy said Umno and its former president Dr Mahathir Mohamad were pinning the blame on MIC president S Samy Vellu in order to 'cover up their own sins' with regards to the Indian community.

Commenting on the 'slipper garland' controversy, the Hindraf leader said he also understands why Mahathir was not interested in an apology from the MIC delegate who made the remark.

"Having observed Mahathir ever since I heard him speak at a student function in London in 1989, I know how the man thinks," Waythamoorthy told Malaysiakini.

"When Mahathir says he's not interested in something, I know he means it."

According to this school of thought, Mahathir did not do anything at all for the Indian community during his 22 years as prime minister. Hence, he does not expect Indians to be grateful to him.

"So, if any Indian insults him, he knows that he has to just grin and take it," said Waythamoorthy.

"In fact, he's probably surprised deep down that he has not been insulted at all so far and Samy (Vellu) instead gets all the blame, a situation he encourages."

'Covering up sins'

The Hindraf chief noted that Samy Vellu has come under all around fire including from Mahathir and Umno for not doing enough for the Indian community "but this is just to cover up their own sins."

"The fact remains that Samy Vellu is not the prime minister of Malaysia. If he were, we can blame him for not doing enough or anything for the Indian community," he said.

"It is Mahathir who should be blamed. He's trying to shift the blame on to Samy Vellu. Mahathir failed to be the prime minister for all Malaysians. He was more interested in his own petty racist agenda."

So, it's not surprising that someone in MIC suggested a 'garland of slippers' for him, he added.

Waythamoorthy also called on the MIC president to stop parroting about Mahathir being a great leader, a great man, a great statesman and a builder of the nation, among others, "since he (Mahathir) didn't do anything at all for the Indian community and in fact set out to hurt them and others as well."

"After all the prime minister is supposed to be the leader for all Malaysians, under the Federal Constitution, not just for some Malaysians," he said.

On Umno's claims that the government had allocated considerable funds for the Indian community but Samy Vellu did not pass them on, Wayathamoorthy wanted the claims to be backed up by facts and figures and other relevant evidence.

The first of Mahathir's'sins' against the Indian community and Malaysians in general, stressed Waythamoorthy, was to distort and deviate from the New Economic Policy (NEP) and introduce racist elements which set the nation on a slippery slope and the Indians among the worst-hit victims.

As an example he cited the withdrawal of recognition for degrees from overseas medical institutions which had a large number of Indian Malaysian students.

He noted that the special privileges meant for the Malays, and by extension other natives, only covered four areas - intake into the civil service, intake into institutions of higher learning, government scholarships and opportunities in business.

"The special privileges were only meant to ensure that the Malays and other natives were not left out as the nation developed since there was this fear at independence," said Waythamoorthy. "It is not a carte blanc (blank cheque) to grab the whole pie in the four areas mentioned and other areas as well."Mahathir will not apologise

In any case, Waythamoorthy doesn't expect Mahathir to apologise to the Indian community for past hurts and sleights "although time is running out for him."

Similarly, he does not expect Mahathir to apologise to his former heir apparent, Anwar Ibrahim, for doing everything possible to destroy not only his political career but the man himself.

"Samy Vellu himself has labelled Mahathir as the destroyer of deputies," said Waythamoorthy.

The Hindraf leader said Mahathir is more concerned about Umno leaders insulting or humiliating him and getting away with it.

In short, that's why Mahathir is using the "garland of slippers" insult as an excuse to name all those who had insulted or humiliated him in the past and are still walking around scott-free.

His suggestion that he would not hesitate to drop them from the cabinet if he had his way, suggested Waythamoorthy, was a strong hint for Prime Minister Najib Abdul Razak "to do what is necessary to avenge his hurt pride".

Rakyat Malaysia yang berbilang kaum agar sensitive keatas padangan agama, mereka masing masing mengamalkan ibata dan agama yang tersendiri, namun kini kaum Cina dan Kaum Tionghua amat minat mengkaji Islam, mereka ingin mengetahui dan memahami dengan lebih dalam dalam pengajian Islam. – Kenapa kah pandangan masyarakat Kaum Tionghua dan Kaum India di Malaysia jadi sedemikian rupa?

Mereka amat ghairah di mana mereka mempercayai Islam adalah agama mulia, mereka mempercayai Islam di Malaysia ada banyak perbezaan jika dibandingkan dengan Islam yang di amalkan di negar alain.

Mereka jua terperanjat di mana di Malaysia, terujudnya golongan extremist yang menganggap dirinya sebagai Pembela Allah. Golongan ini khasnya pandai memutarbelitkan fakta fakta ajaran Islam dan di ekploitasi kan sebagai modal politik.

Golongn pembela Allah ini lah yang penuh karismatik serta pandai dalam selok belok memutar belit dalam ajaran Islam, cita cita mereka hanya mahukan Malaysia ini di takbir oleh Melayu Islam kononnya. Padahal sebelum kedatangan Islam ke Tanah Melayu, hingga Islam jadi agama termasyur di Dunia ini , pembela Islam dari Malaysia tidak pernah menyumbang apa apa terhadap Islam , Cuma air liur yang berbau Islam, tapi rasuah, kezaliman dan memperkosakan rakyat ikut sentiment perkauman.

Pandai juga pembela Allah ini menyebarkan sentiment perkauman dan membarakkan semangat anti bangsa lain. Penindasan keatas kaum lain serta menyalurkan ideology haram sini haram sana, tidak kurang juga brainwashed keatas kaumnya untuk membencii kaum lain.

Kaum Melayu yang dilahirkan di Malaysia dapat sifatkan kaum yang tidak dapat menikmati kebebasan beragama. Mereka di lahirkan dan ditakdirkan sebagai Muslim, di mana sejak bila dilahirkan perlembagaan Malaysia telah tetapkan nasib mereka sebagai Islam keturunan. Jadi Kenapa kah Melayu Islam ini patut banggakan dirinya sebagai Muslim? Pada hal bagi kaum kafir ingin menganut agama Islam adalah begitu mudah sekali!! Rasanya tidak samapai 15 minit sudah layak jadi seorang Muslim. Tetapi maslahnya kalau hendak jadi seorang muslim yang baik dan disegani kemungkinan perlukan sepenuh hayat !!

Lihatnya PRK di pematang pasir, Bukit Gantang dimana dibandingkan kaum Cina memperjuangankan Islam lalu memberikan sokongan kepada PAS. Kalau dibandingkan dengan Manek Urai, nampaknya Melayu sendiri lah yang mendokong fahaman materialistic , rasuah , tidak mempercayai akhirat dan membelakangkan ajaran Islam sendiri. Di mana UMNO lah puak yang mengajar Melayu mengejar faham syaitan yang tidak seimbang dengan ajaran Islam yang jati.

Malaysia Sympathetic To Muslim Terrorists?

Malaysia's BERNAMA News Agency carried the following report:

PUTRAJAYA, Sept 18 (Bernama) -- Prime Minister Datuk Seri Najib Tun Razak said Friday it was improper to label Malaysia as an "exporter" of militants because terrorism was a regional or global problem unrestricted by national boundaries.

He said it was futile for countries to point fingers at one another in the matter.

"Even in the case of the Sept 11 (2001) attacks (on the twin towers of the World Trade Centre) in the United States, the terrorists came from outside that country. This only goes to show that we are faced with a global issue, not something confined to any one country," he said.

Najib responded thus when asked to comment on the killing of Malaysian Noordin Mohd Top, Southeast Asia's most wanted militant, in a police raid in Solo, central Java, Thursday.

Noordin, who had been a member of the Jemaah Islamiah (JI), was the mastermind behind a series of bomb explosions in Bali and Jakarta which had claimed hundreds of lives. Najib said problems associated with terrorism required the cooperation of the affected countries and even covered cooperation at the global level.

"Noordin was actually influenced by Abu Bakar Bashir, an Indonesian national. So, to say that we (Malaysia) export militants is not right because he (Noordin) was influenced by Abu Bakar Bashir of Indonesia who had opened a religious school in Ulu Tiram, Johor. That was how it all started.

"As we all know, terrorism is a regional and global problem. It knows no national boundaries. As such, there must be cooperation between our countries and, in fact, at the global level, if we want to stem this threat," he said.

KUALA LUMPUR: Terrorist Noordin Md Top, who was shot dead by Indonesian police, could have been rehabilitated.

Home Minister Datuk Seri Hisha?mmuddin Tun Hussein said he was sad to hear about the death.

“What he did was wrong. We don’t condone what he did. I am sad that we did not get to rehabilitate him, like we have done with many others, including Jemaah Islamiah militants.

“I am sad because a life is a life,” he told reporters after watching personnel from the police, Rela, Civil Defence Department and Rescue and Safety Department carry out Ops Sikap at the Jalan Duta toll here.

Noordin, a militant mastermind who eluded capture for nine years and terrorised Indonesia with a string of deadly bombings, was killed during a shoot-out in central Indonesia yesterday.

Hishammuddin said the Government would help Noordin’s family bring the body back after the authorities completed their investigations.

He said Noordin’s identity had been confirmed through a fingerprint check but a DNA test would be conducted to verify the result.

Hishammuddin said Malaysia had cooperated with all parties, including Indonesia, in cross-border crime, but added that Malaysia had no part in yesterday’s raid.

Reading the above statements coming out from the PM and Home Minister gives one the impression that the cold blooded murderer and terrorist Noordin Top appear to have sympathizers in the BN/Umno regime of Malaysia.

Maybe, both Najib and Hishamuddin are sad of the demise of a Melayu Glokal and Towering Malay in Noordin Top. This explains why the Indonesians have such resentment towards Malaysians today. Just look how pathetic Najib's reasoning is. He is now blaming the Indonesians for making a monster out of Noordin Top.

It is not surprising now to understand why racists and bigots as long as they come under the umbrella of Islam and the Malay race, they can get away with anything in this country. The cow head incident is one fine example.

The Scribe wouldn't be surprised if the Evil BN/Umno regime will accord a State Funeral for the brigand Noordin Top. In fact, don't be surprised if Noordin Top will appear in Malaysian history textbooks as a 'Pejuang Islam Melayu Yang Mati Syahid' (A Muslim Malay Fighter who was Martyred).

It appears that Malaysia is begging to be inducted into the League of Terrorist States.

MIC SHOULD APOLOGIZE TO DR MAHATHIR

As for now, I am joining the calls of the blogosphere in asking MIC to apologize to Tun Dr Mahathir (pic above right) for the insults and criticisms by the President and a MIC leader.

In the case of Penang UMNO vs Penang Gerakan, Dato Ahmad Ismail (pic above left) tore apart and stamped the picture of Tan Sri Koh Tsu Koon, the Gerakan President.

Subsequently, Datuk Ahmad Ismail was suspended from all positions and UMNO for 3 years.

When Datuk Ahmad Ismail uttered the words pendatang and tore apart the picture of TS Koh Tsu Koon, UMNO took swift action and handed the man a 3 year suspension from all posts and UMNO membership.

Given the utter disrespect from the MIC delegate for saying such things, it is only rational for others especially from UMNO to call for the suspension of that man.

Today, we hear news that an MIC leader wants to garland Tun Mahathir's portrait with slippers. Such a level of disrespect if carried out, should be sent into political retirement with a letter of membership termination.

Given that he paid lip service only, the matter should be handle in the same way UMNO handled Datuk Ahmad Ismail's case.

Suspend the man and MIC should send an official apology to Tun Mahathir ! A PIECE OF MY MIND hopes to see some action taken soon.

A Garland of Slippers for Mahathir from MIC?

Muntadhar al-Zaidi was released from Iraqi prison after serving nine months for the crime of throwing a shoe at President George W. Bush on his last trip to Iraq (the joke inside the country was Mr. Zaidi’s conviction was handed down because he missed.)

The TV journalist has become something of a local hero for expressing widespread public anger at Bush and America in such a dramatic way. In Arab cultures, it’s considered impolite merely to expose the sole of your foot. Superstitious Iraqis hang baby shoes from their rear-view mirrors to ward off bad luck and the evil eye. Throwing a shoe? That’s a declaration of war.

Though there are now serious issues to be dealt with in the wake of Zaidi’s release – he came out of jail with a front tooth missing and alleges he was tortured by officials during his detention – he’s not the first man in history to make a splash using a shoe for something other than its intended purpose. And he spawned a legion of imitators, from Britain to India.

In Malaysia, there is now a hue and cry from the Ketuanan Melayu bigots and their posse under the guise of Malay/Muslim NGO's screaming for blood after an MIC delegate (who got 'carried away' after MIC supremo Samy Vellu's fiery rhetoric admonishing former PM Mahathir Mohamad for MIC's current ills) suggested that a 'garland of slippers' be placed on the portrait of the former prime minister.

Deputy Prime Minister Muhyiddin Yassin wants MIC president Datuk Seri S. Samy Vellu to take action against the MIC delegate who had suggested placing a 'garland of slippers' on the portrait of former prime minister Tun Dr Mahathir Mohamad.

He said this was because the suggestion was considered to be disrespectful to the leader, and 'the faster action is taken, the better' (Hey MooHeeDin, What about Bush ah?).What's more hypocritical is that Mahathir's junior, Mukhriz is now demanding for MIC to apologize to the Indian Muslim Kerala Kutty Mahathir over the issue. The bigot son of a Mamak Mukhriz is the one who should apologize the the Hindu community over his sympathetic support for the demonic cow head demonstrators together with the racist Home Minister Hishamuddin Hussein.These bigoted Umnoputras and their sympathizers reveled when Muntadhar al-Zaidi threw his show at Bush. Now, however, they are making a big fuss over the statement made by the MIC delegate. What a bunch of hypocrites! They should be grateful that until now, none of their BN/Umno leaders have been hit with a shoe or a slipper.

Corporate Responsibility & National Development

I refer to "Good life turns sour for apartment owners" in Malaysiakini.

I felt sad reading about the plight the people are in through no fault
of their own.

Segi Objective (M) Sdn Bhd. and Vibrant Leisure Sdn Bhd. are both
100%-owned subsidiaries of MK Land Holdings Bhd.

Isn't it the responsibility of MK Land Holdings Bhd. to ensure that
it's subsidiaries fulfil all obligations to their customers?

In the event the subsidiaries cannot fulfil those obligations, doesn't
the parent corporation, in this case MK Land Holdings Bhd., have to
make full restitution to the customers, such as a full refund of all
monies paid, with interest, so as to make it as though the customer
never had any dealings with the subsidiaries?

Shouldn't the parent corporation also pay any legal fees involved and
compensate the customers for the time they wasted?

My opinion is that a corporation cannot disclaim responsibility for
the acts or promises or statements of its subsidiaries or employees.

I also think that MK Land Holdings Bhd. should sort out the mess
caused by it's subsidiaries if Mustapha Kamal (picture above - the MK behind MK Land)
wishes to maintain his good name and the good reputation of MK Land
for social responsibility.

My suggestions to avoid a repeat of problems with a developer:

The developer have to set up a Trust Fund to fulfil any future
obligations OR require all developers pay into an insurance pool that
will compensate buyers AND require that developers obtain funds from
banks, not buyers, to build projects AND the banks carefully asses the
developers before providing a loan. The insurance company will also
have to be careful that only capable developers can be part of the
pool.

Build quality should also be paramount. Contractors should employ
specialists, a carpenter to to do carpentry, a roofer to do roofs, an
electrician to do wiring, etc. rather than employing people who are a
"jack of all trades" and do nothing well except mucking things up.

Government can help by licensing trained tradespeople, e.g. plumbers
and electricians and ensuring they do only tasks they are licensed
for. The handbills stuffed in letterboxes saying "We are specialised
in" and then listing 10 or more things should become a thing of the
past as Malaysia develops.

To provide trained tradespeople vocational colleges will be needed.

The Education Ministry can assist by ensuring there are sufficient
places in the vocational colleges for the electricians, auto
mechanics, etc.

See how the construction industry and Education Ministry are linked?

Everything is linked in modern societies.

To become a fully developed nation Malaysia has to develop all types
of links within society, education, industry, government, social
services, agriculture, to name a few.

My name is Muthaiah Alagappan and I'm from Johor Bahru. I've gone through your article in

Sometimes, I also don't understand our people. Easily they get conned by others and they don't
want to see with the broadmind and very quickly forget the past. The long term solution is totally
out of their focus.

comments from the public, you'll know that they're spitting on their own face. Even we can call
them the "ETTAPAN". Their behaviour and attitute are really disgraceful to our society.

Mr.Vijay, quite sometime ago, I've posted an article with the title "Malaysian Indians And The

Yes mindsets need to be changed,I think they are better off on a multiracial platform, a population that makes up 7% has very little political muscle as a rase based party, even the malays at 60% are split, the irony is for the Indians to get justice they must change teir whiny mindset, and ironically identify themselves as malaysians 1st and not Indian 1st, look at the punjabi's no special govt assistance , no vernacular schools yet doing ok economically and still able to maintain their culture and language, such notions as only race based party's being viable are not written in stone, things change -the CD replaced the cassete deck, the constitution protects all cultures , the fear of assilmiliation causes people to be too defensive, case in point the punjabi's, why are they so different ? they had to come up on their own the Indians like the malays were waiting for handouts the malays got some the indians got crumbs.
After long debates with Hindraf members , they told me they are afraid that Pakatan may treat them the same way as BN when they come to power, my reply to them is why fear about something that has not happened, and sabotage a party that is trying to help against one that has abused you for 50 years, thats why I call it irrational fear.

I'm very happy because both of us are sharing the same thoughts. This is what I use to argue/discuss
with some of my friends here in JB. I always reminding them that 1st we're only 7.8% in the term of
the population and 2nd (which is more important factor) we're financially down, so our "VOICE" will
become very very low and sometime people don't even want to listen. So no point of fighting for the
equal rights as an Indian, there for we have to fight for the equal rights as a Malaysian together with
our Chinese and Malay brothers. ONLY by doing that way, it can give the impact otherwise it will be
like talking to the wall.

Personally I don't like race base party.

Mr.Vijay, I'm not so fluent in English so please forgive me because there will be lot of grammar errors
in my article but I believe with your capability, you will be able to understand what I'm trying to explain.

Originally I've forwarded that article to the Hindraf leader and then to most of the Indian Politicians in
PR Government (but none of them replied) and finally to as many Indians that I can reach through the
e-mails and today I'm forwarding to you. By the way if you want to understand the "ACTUAL" message
of that article then you have to be VERY VERY OPEN MINDED otherwise either you will get angry on

Malaysian Indians And The Actual Reason Behind Their Problems.

As I've promised earlier, today I would like to share my opinion about Malaysian Indians And The Actual Reason Behind Their Problems. I strongly believe if we can correct our previous mistake, it will be the turning point for our Malaysian Indian's future. It's very long e-mail so please make sure that you're really free to continue reading this e-mail and if you feel more comfortable with a cup of coffee or tea then may be you should get a cup of tea or coffee.

To be honest to you, on 16/07/08 I’ve sent this e-mail to our "brother" who’s in UK. I’m sure you know who I’m reffering to.

Actually I was thinking to write about it and send it to as many Indians that I can reach and ask their favour to forward it to the attention and consideration of all their Indian friends. Probably you might support the idea or may be against it like most of other ordinary Indians see it. Anyway allow me to explain about it in more details but before that PLEASE FORGIVE ME because my explanation is regarding one of the most sensetive topic among the Malaysian Indians and might hurt the feeling.

From my observation, the CORE for the entire problems that we Malaysian Indians asspecially for those in the middle and low income groups facing are created by TAMIL SCHOOL. May be you might shock to hear this but I will explain it in detail why and how Tamil School is the root cause for the entire problems that we Indians are facing here in Malaysia.

The "poison" statement "WITHOUT THE TAMIL SCHOOL EXISTING IN MALAYSIA, TAMIL LANGUAGE WILL DIE OFF" already been "injected" into all Indians MIND asspecially into Tamilians mind for more than 50 years by 2 well known groups. The first group is Malaysian Indian Politicians, I'm sure you know who I meant by Malaysian Indian Politician and the second group is the Tamil School Teachers and Headmasters.

Malaysian Indian Politicians

As we all know that most of our (former) Malaysia Indian Politicians are very cunning type of people and all they know is to swindle the Allocated Funds for Indians Welfare in Malaysia. As every of us know well, the most popular subject for this allocated funds matter are Tamil School, Education, Temple and so on. The No.1 "capitol" or the "modal" for this Indian Politician to make use of the “opportunity” is the Tamil School matters and followed by others matters. If I'm not mistaken quite sometimes back our Government has allocated RM120 million for Tamil Schools. Whether that money fully will reach Tamil School or not, the money surely need to pass through this politicians hand before reach to the Tamil Schools. The rest I think I no need to explain, you know very well what will happened.

All of us will agree that eventhough after 50 years of independent the standard and the condition of many Tamil Schools remained the same like how it were before the independent. So even after 50 years of independent the condition of many Tamil Schools remain unchanged, so what make you think that in next 50 years it will change positively, asspecially with all the "Crocodile" (former) Indian Politician around???

In your opinion are they really want this Tamil School problem to be solved? Well, think again. As I've mentioned earlier, Tamil School subject is the "capitol" for their "business" so do you think they want this problem to be solved? As an eye wash they will do their "acting" by voicing this topic here and there but deep in their heart they're happy because with the existing of this Tamil School problem they can continue earning (swindle) from generation to generation.

Tamil School Teachers and Headmasters

As for them, the matter is very straight forward. In their opinion without Tamil School, there's NO JOB for them. Sometimes they also are involved in Politics as well. So to protect their interest (rice bowl), they also will spread the news that “Without Tamil School Existing In Malaysia, Tamil Language Will Die Off ”, it's purely because of their selfishness. In Indian society Teachers and Doctors are well respected people so whatever they said it's equally like God's statement. So because of that, the poison statement already been buried long ago into the mind of our great grand father to grand father, grand father to father and from father to son.

So in another word it's like an advice from the God, so how you expect an ordinary Indian to go against it.... These teachers and headmasters forgot that their service are also needed in the ordinary schools (Sekolah Kebangsaan). So to have their "own kingdom" in place they don't mind to support the idea eventhough some Tamil Schools building structure are counting the day to collapse.

On every Monday and Wednesday's Vizhutugal Programme (Astro 201) there will be a newspaper segment and almost in all the newspaper segment there will be a topic about problems faced by Tamil Schools all around Malaysia. Trust me, it's the same old problems which is not been solved and will not be solved in the near future.

Now lets go to more realistic topic regarding Tamil School.
There are 3 groups of Indians in Malaysia involved directly or indirectly with our education system and they're a) Very Very Rich b) Earning >< $5000 and c)Earning >< $1000. a) Very Very Rich This is the smallest group of Indian and to be honest, I have nothing much to comment about them because I'm very sure that they know what they're doing and know how to manage their problem. Probably all their kids will be graduates from overseas and automatically jobs will be waiting for them. b) Earning >< $5000 Probably they're the biggest group or second biggest group and probably facing difficulty to survive equally in Malaysia. It's because they are not rich and at the same time they're also not poor. Some of them will send their kids to Sekolah Kebangsaan and some will send to Sekolah Jenis Kebangsaan. If they send their kids either to Tamil School or Sekolah Kebangsaan, most of the time their kids can score well because their parents has the knowledge to guide and at the same time they're financially capable to send their kids for tuition classes. So chances for their kids to be a successful person is great. If they can't find a suitable job locally they always have a better option at overseas. c) Earning >< $1000
Probably they are the biggest group or second biggest group and probably facing the worst nightmare just to survive. It's because they're financially and educationally down from generation to genaration. They just earn their living by doing any type of job and most of the time they’re doing more than one job just to survive. This is the area where TAMIL SCHOOL plays its part directly and indirectly in the life of the people from this low income group.

The poison statement " WITHOUT THE TAMIL SCHOOL EXISTING IN MALAYSIA, TAMIL LANGUAGE WILL DIE OFF" ideology works perfectly in the mind of this group because as I mentioned earlier that they're educationally and financially down from generation to generation so their IQ level is very low and these 2 groups (Politician and Teacher) easily can exploit this situation for their personal benefit.

Just for the sake to send their kids to school they will send their kids to Tamil School and hardly can guide them, tuition class is totally unimaginable for these kids because their parents can't effort. So most of these kids will go to school because of their friends circle are at that school and since they already in the school they will study. After few years they need to go to secondary school and there is where their worst nightmare going to start. Once in the secondary school, language wise they're handicap because now they need to communicate in Bahasa Malaysia and automatically they will become like a stranger in that school where majority of the students are from other races.

Like it or not, now they need to continue their studies in BM and due to their weake or minus point in BM they won't be able to follow what their teachers are teaching and as a result they couldn't score well or fail most of their monthly class exam and Government examination as well. So what's next....... Since they don't have a good result in their examination they can't get a good job and of course their parents also can't effort to send them continuously to study. So now onwards these kids going to face the actual unknown future and need to struggle to survive again as the member from the financially and educationally down generation to generation group.

At this point may be someone will try to deny my point by saying that there are still Tamil School students from low income group but doing well in their exam by getting 10A1, 9A1, 8A1 and so on. I totally agree with that BUT how many of them are doing well. As an example, out of 1000 students from Tamil School base, probably 5 to 10 percent will be getting good result. I'm not worry about this 5 to 10 percent BUT my worries is on the remaining 90 to 95 percent Indian students that almost none of them having a good future. How about them, what they're going to do for the rest of their lifetime? This is what I'm worrying.

Since they need to survive, this remaining 90 percent will try to get any type of jobs that they can get with the low qualification that they have. Jobs like Factory Workers, General Cleaners, Construction Workers, Lorry/Bus Drivers and Security Guards will be the types of jobs that these youngsters will get.

Out of this 90 percent, some will be "choosing" or "forced" to choose some different type of jobs and that jobs will be related to Gangsterism, Killing, Robbers, Kidnapping, Hijacking, Drug Pusher, Con Man, Snatch Thief and so on and most of them will be an Alcoholic. At the end of the day most of them will become the victim to the police bullets. Trust me, personally I don't like to write this paragraph but I have no choice because like it or not this is the actual facts. If some one have the access to the police record then they will know that most of the Malaysian Indian arrested or shot by police are ex-Tamil School students. Few years back I still remember reading an article that Indian population is Malaysia was 2.5 million but today the number has decreased to 1.8 million, so what happened to the balance 700,000 Malaysian Indians??? Besides migrated and died because of old age, many of them died because of a) Alcohol b) Drug c) Gangsterism d) Police Bullets e) And at last but not least many of them already became Permanent Resident in the prison.

Why they fall into these groups or choosen this type of live where definitely there is no future? In many situation the answer is because they couldn't find a job easily like other youngsters from other races. Further more they probably don't have enough academical qualification to apply for a decent jobs. The situation become more worse with the pressure from the parents which at the end these youngsters find the short cut way for their survival. Honestly speaking none of them ever dreamed that their life will end up horribly like that. In 70's and 80's we can be proud that lot of our Indians were doing very well in sports but today situation is the other way around. The moment we see any negative news in newspaper we start to wondering and worried that the incident probably involving Indians. In another word, percentage of Indians involved in crime activities are very high compare to other races.

So now, who to blame? What is the root cause of this problem? Eventhough those Politicians and Teachers are the instigators of the problem, don't you think Tamil School is the actual root cause of the problem? As a Tamilian, here I would like to say something firmly... I'm not against TAMIL LANGUAGE but I don't agree with the Tamil School concept because indirectly it's the "factory" that "manufacturing" "products" for the police to test their shooting accuracy.

I'm 100 percent very sure about Tamil School matter because personally my family also directly effected. My late father was working as a school gardener with RM330 as his salary in 80's, I'm the elder son and I have 2 younger sisters. My father sent me and my first sister to Sekolah Kebangsaan and my second sister to Sekolah Jenis Kebangsaan (T). RM330 is not enough to run a family of five, so my father has to go for a second job and to support my father my mother also worked as a part time house maid in two houses. Still my parents couldn't effort to send us to tuition classes and besides that many other problems that we've faced due to poverty. The most sad part was that me and my sisters as the growing kids almost never had any opportunity to spend with my father because he has to wake up earlier than us to go to work and once reached home he will get ready and go out for his second job and returned home after we all went to bed.

Only myself able to complete the SPM wherelse my both sisters failed their SRP. Me and my sister from Sekolah Kebangsaan able to cummunicate in Malay quite well and able to handle many official things but my sister from Tamil School, not able to cummunicate well and cannot handle any official things. There for she always needs our assistance in almost all her matters. So this is what generally will happen to Tamil School students who're from low income families.

Some Indians who don't understand exactly our Indian problem always will try to compare with the Chinese and Chinese School. As for them I would like to say something. Chinese economy or financial level are many many times better than us. Further more their language is Commercial Language similar like English and according to the statistic Mandarin is the most spoken language in the world where there are 1,075,000,000 people speaking this language worldwide followed by English with 514,000,000 and Hindi 496,000,000.

In China, if let say one Chinese guy from north, one from south, one from west and one from east meet at one place, in your opinion what will be the language probably used by them to communicate? I think all of you will agree if I say they probably will use Mandarin to communicate. If the same situation happened in India, in your opinion what will be the language used by that 4 Indians from north, south, west and east to communicate? I think you'll agree if I say either English or Hindi. So if you agree with me on this then I'm sure you will agree if I say that there is no point comparing Chinese and Chinese School with Indian and Tamil School in Malaysia because it's two diffirent situations. I'm not sure what is the exact rank for Tamil in that list but definetely not in the top ten list. Anyway I've attached the Top Ten Chart Of Most Spoken Language in the world together with this e-mail.

So no point of comparing Tamil one to one with other language such as Mandarin, English or Bahasa Malaysia asspecially in Malaysia BUT as a Tamilan I strongly believe every Tamilan should be able to read, write and talk in Tamil fluently. In the bigger picture every Tamil student ATLEAST must be able to speak, read and write fluently in English, Bahasa Malaysia and Tamil and if possible in other commercial language as well. So for that, what should we do???

Our schooling method need to be changed. Definitely with the Tamil School concept it's hard to achieve that. With the current Sekolah Kebangsaan concept also it's quite difficult to achieve it. What we need is to have a new method of schooling where Mother Tonque is a COMPULSARY subject from standard one till form five or form six and it's encouragable if it can be extended in Universities. Mother Tonque exam marks need to be treated equally like Bahasa Malaysia. If fail Mother Tonque or getting lower marks, the situation has to be same like how if we failed or getting lower marks in Bahasa Malaysia. If this schooling method become reality, the 90 percent of the students that I've mentioned earlier won't suffer as how they are suffering now because if they have a good command in English they can go anywhere in the world to get a job but at this moment they're stranded here because lack of knowledge and not fluent in English.

Trust me, it's not that our local Indian Politician didn't know about it but purposely they won't let it happen because if that kind of education system become reality they're the one who lost badly because they no longer can use the Tamil School topic to swindle the allocated funds from the Government for Indian Community's welfare where Tamil School topic are one of the main agenda. According to some old friends many years back there were some genuine Malaysian Indian Politician ever brought up this matter but the other powerful "crocodile" Malaysian Indian Politicians put a full stop sarcasticly for that topic and has condemned that genuine politician.

Once in a while we will hear one very famous question been raised in Tamil TV or Radio Programmes and the question is “ TAMIL SORRE PODUMA” or in English, whether professionally we can live or survive with Tamil? If this question been raised to a Tamil School Teachers, Tamil News Reader or Reporters and Tamil TV/RADIO Presenters of course the answer is YES but if the same question been raised to the other professionals such as Engineers, Lawyers, Managers, Doctors, Pilots and others then the answer definitely will be NO.

I just got to know that there are only 1.2 percent of Indian Staffs in Government sectors in Malaysia while our population is 7.8 percent.

There is another important thing that I must mention here. Suppose if the island with name of Singapore doesn’t exist on the map or didn’t located just 1.5 km from Johor Bahru and can’t be reached through the land, honestly speaking I don’t know what will happened to the survival of tens probably hundreds thousand of our Malaysian Indians. In another word, indirectly Singapore has absorbed and has reduced Malaysia’s actual responsibility to provide jobs to all its citizen. There are lot of Malaysian Indians working in Singapore in all the sectors as Doctor, Surgeon, Teacher, Professor, Principle, Engineer, Architect, Manager, Banker, Media, Pilot, Air Stewart, Air Stewardess, Nurse, Clerk, Hotel Line, Driver, Shipping Line, Shipyard, Construction, Factory Worker, Shopping Centre Staffs, Security Guards and so on. We have to thank to God and to Singapore otherwise these Malaysian Indian and their families going to face lot of difficulties and the crime rate and the social problem which Malaysian Indians going to contribute will be much much more higher compare to the current rate.

Now I would like to add one more incident to support my comment and it just happened on last Sunday (30/11/08). One of my best friend called me and asked me to come to his place (about 8 km from my house). Once I reached to his house we started to chit chat for a while then he asked me a favour to help fill up one job application form for his younger brother who is looking for a job in Singapore. Basically it was a simple form but his younger brother didn’t know to fill up the form and I was thinking that he was a primary school drop out.

So, I’ve started to fill up the form while his younger brother sitting infront of me to provide the requested informations. So after about 10 minutes filling up that form, it reached to a column where the education information is needed. I’ve asked him and he gave the answer that his primary education was from a Tamil School and continued his secondary until SRP in Sekolah Kebangsaan. So my next question to him was, why he couldn’t fill up that form and his answer was that he didn’t know how to fill up the form because he didn’t understand what was required in that form.

So in this case who to blame??? YB, don’t you agree that this guy belong to the 90 percent from the ex-Tamil School students that I’ve mentioned earlier??? So how we are going to solve this problem PERMANENTLY??? In medical term, there is one statement “PREVENT IS BETTER THEN CURE” So how we are going to prevent this type of situation permanently in future??? As I’ve suggested earlier, the only way we can get rid of this problem permanently is by having a better education system and for that we have no choice besides get rid of Tamil School type of education and replace it with an education system where all the students regardless of their races study in one school AND the Mother Tonque must be a Compulsory Subject till the higher level. Not to forget, English also MUST be taught in a better system compare to the current situation. Every Indian must have a Working Skill (atleast a Diploma).

ONLY by doing that, our students will get a better quality education, able to mix around, better schooling environment and able to master Bahasa Malaysia, English and Mother Tongue.

I really hope all the PKR, DAP and PSM YBs and others will sit together and will seriously consider my suggestion. Our society is financially down so at this point of time ONLY a better education system prefably with some Additional Skill Certificate (atleast a diploma) will help to solve the Malaysian Indians Problem in the long run.
